R. v Okemow, 2017 MBCA 59 (Mainella JA)

Appeal from blended adult and youth sentence imposed on young person following guilty pleas to 14 offences, including two armed robberies - FASD and ADHD diagnoses - prospects for rehabilitation and reintegration are illusory. Assessing moral blameworthiness for an offender with mental illness or cognitive limitation is a tactful and considerate exercise - need cogent evidence linking diagnosis to conduct and a determination about the degree to which FASD played role in criminal conduct - FASD relevant to reduced blameworthiness, but presumption rebutted despite diagnosis
