Voluntariness - R. v. Friesen, 2007 MBQB 240 (voir dire); 2007 MBQB 241

R. v. Friesen, 2007 MBQB 240 (voir dire); 2007 MBQB 241 (conviction) (Schulman J.):

Accused with FAS made inculpatory statements in context of arson investigation – accused showed awareness of rights – statements voluntary. Note that on the conviction, the judge noted that the accused’s condition meant that he believes he didn’t set the fire but doesn’t really remember.  Also an observation that he can’t link cause and effect.
