Sentencing of Aboriginal offender for dangerous driving causing death – ARND diagnosis – difficulty in anticipating consequences and controlling impulses allow understanding of criminal record, especially breaches of court orders – degree of moral culpability at lower end of scale – FASD could be managed with community based supports and programming – 4 year sentence less credit for time served, 3 year’s probation, lifetime driving prohibition.
