FASD & the Justice System

R. v. Kendi, 2011 YKTC 37 (Ruddy J.):

Sentencing of offender with FASD for domestic assault – significant deficits in higher order thinking – general and specific deterrence not relevant – issue is balancing rehabilitation with protection of the public – jail not ideal but no community placement with appropriate level of support and supervision – six months jail – time for transition planning.
