FASD & the Justice System

R. v. JKE, 2005 YKSC 61 (Veale J.):

Sentencing of offender with pFAS for manslaughter relating to death of infant – offender poses ‘time bomb’ – had extensive supports for planned pregnancy – previous conviction for assaulting child – high risk of violence – FASD is significant mitigating factor, but does not explain violence – offender will not benefit from harsh punishment -  Fraser Valley Institute with structured environment and appropriate programming – 3.5 years jail.
