FASD & the Justice System

R. v. Suarak (2001), 199 Nfld & PEIR 119, 2007 CanLII 37590 (SC) (O’Regan J.):

Sentencing of offender on B&E, breach – “suggestion that he may suffer from FAS” considered a mitigating factor – protection of public required – federal system with better programming and aggravating factors outweigh mitigating – five years (see also R. v. Suarak, 2007 NLTD 5, where it seems Mr. Suarak does not have FASD).
